This is what our government is doing to our families.  The state requires funding from federal purse and will do anything to achieve their means.  The young girl when inside almost had her face smashed into a fish tank by unprofessional Queensland police.  <br />
<br />
It was agreed by many of our peers and people in the Department of Child Safety that our children should not have been taken from us.<br />
<br />
After the long bloody court battle we had our children returned and the once close and happy siblings personalities were tampered with and it took a year to settle them again.  They are happy at home now.<br />
<br />
We found self representing ourselves was the only way to get justice as the legal aid system here is over relaxed, self serving, powerless against power corrupted police and a nanny state government.<br />
<br />
Australians at a state level lack any human rights.<br />
<br />
Children are dying at the hands of a verbose government who fails to care more than the parents they accuse.<br />

Aboriginal made ward of State as infant<br />
<br />
The appellant was an Aboriginal who, as an infant, was taken from the custody of his family and made a ward of the State. He sought to bring an action for negligence and breach of statutory duties against the Department of Community Services after the expiration of the limitation period. The appellant argued that he suffered psychiatric illness which was causally related to the mistreatment he experienced while a ward of the State. He sought an extension of time upon the basis that he did not become aware of the existence of the illness or its connection with the respondent's conduct until he received the respondents' file in 1997, and read the reports prepared by a psychiatrist in 1997. The respondent sought to have the matter dismissed for want of a cause of action. Held: (allowing the appeal)<br />
<br />
    * (1) The master erred in finding that the appellant did not establish that he was unaware of a material fact of a decisive character within the time period. Although the evidence established that the appellant was aware that his foster parents were being violent towards him, that awareness was not what grounds the Statement of Claim. The appellant was not seeking to sue for physical injury sustained as a result of that violence, but rather, was seeking to sue for the psychiatric consequences of the violence.<br />
    * (2) It was not until 1997, when the appellant sought and received the respondents' file and read reports prepared by a psychiatrist, that the appellant was aware of both the nature and extent of his injuries and the connection between them and the respondents' conduct. Accordingly, the appellant satisfied the tests in the Limitation Act 1969 NSW, s 58(2) .<br />
    * (3) There was no evidence that the appellant expected that the physical injuries would lead to a psychological condition. The words in s 60I(1)(a)(iii) are related to an unawareness "of the connection" between injury and acts or omissions. Therefore the appellant satisfied the tests in s 60I(1)(a)(iii) . The master erred in finding that the words of the provision were "concerned with ignorance of the existence of facts and omissions rather than legal conclusions".<br />
    * (4) The appellant established serious questions to be tried. Although the relationship of the parties may be described as a guardian/child relationship, generally recognised as a "moral duty of imperfect obligation and not a relationship which creates duties", the appellant relied upon specific incidents of physical mistreatment. It would be inappropriate to merely class the relationship as moral rather than legal, without regard to facts perhaps indicating a situation where there was a breach of a common law duty of care.<br />

			<description><![CDATA[My nephews are in care of docs nsw. One has recently been removed from school, allegedly because the department can't afford the travel costs for him. He is a child with special needs and in an IM class at school. Apparently he has spent the past week and a half at the carer's due to DoCS not having found him another school yet. My question is, If a parent can be prosecuted due to not sending a child to school, why can DoCS take a child out of school without having another for them to go to?<br />

This is no medicine show magic cure, This stuff really does exactly what everyone claims it does.<br />
<br />
Enough rip into DoCS stuff. Time to look at run down parents and children.<br />
<br />
Court, day care, school what ever the hardships may be, we find ourselves getting sick with flu and infections we may pick up from schools and smelly over used court houses etc etc. We do have to live on the same planet and some of these bugs take advantage of the stress we seem to accumulate along the way.<br />

Recently I got sick. 			<description><![CDATA[This is my appeal to someone here who has had experience with DOCS and can help me by directing me to the right place to save my grandaughters life.<br />

My daughter gave up ***** when she was 6 months old. She gave her to her drug addicted father. he wanted the pension and took the little girl in for the income . I live in QLD and when I learned of this I was absolutly disgusted and tried to contact Tas welfare about the matter and the conditions in which my grandaughter lived.<br />
<br />
I was cut off , lied to, put on hold for ages, told that she was fine and ignored.<br />
I explained to them that my husband and I owned a business, had a good home and to check us out with any agency they needed to to verify our stability and offer of guardianship. I have a 2yr old daughter and a 14 yr old son and I invited them to assess our family and judge for themselves.<br />
They ignored us some more and then made us chase our tails trying to get an answer from them<hr />
This went on for a month and finally we decided that maybe we couldnt help after all and we stopped calling.<br />
A year has passed and my daughter called me last week saying that her father ran away with **** to NSW and has since been jailed and that DOCS are taking her from his girlfriend's house and will place her in foster care if there wasnt another option. I immediatly rang them and told them my story and that I would take her . Again I was ignored. promised to hear from them and promised they would call, but nothing. So I continued to call them and kept getting the run around. left my number and no-one would call.<hr />
This went on for a month and finally we decided that maybe we couldnt help after all and we stopped calling.<br />
A year has passed and my daughter called me last week saying that her father ran away with **** to NSW and has since been jailed and that DOCS are taking her from his girlfriend's house and will place her in foster care if there wasnt another option. At this point she may not live and if she does she is facing brain damage and has lost the sight of one of her eyes and requires extensive plastic surgery amongst the 2 other operations she has had to stop her brain from swelling. All this in a period of 2 days . She is 3 years old.<hr />

			<description><![CDATA[i will keep this short and to the point...my teenager accused her father of abuse..she was removed from my care as i did not believe her allegations and would not turn on my husband..we asked for physical examinations, xrays and independent psychiatric assessments(we offered to pay) which were refused..in 18 months i have seen her 4 times..three by accident and one supervised visit.. after that visit docs told me she was stressed and went to her foster home and cut herself,which my daughter denies to this day...<br />
since being in docs care she has had several suicide attempts,spent 2 months in a mental inst and is on serious meds..docs threatened me with an avo if i went near the hosp..<br />
we or our other kids have never been investigated, no one ever came to the house or spoke to friends or family,the police have not even interviewed my husband no charges have been made and our daughter has admitted to lying about the allegations (which docs said my other daughter and i forced her to do) and wants to come home...which they won't let her..<br />
we now have phone contact and she seems to be doing well ...she just wants to be with us...<br />
our daughter told us she has asked many times to see us and her caseworker told her we wanted nothing to do with her,which is sooo untrue...<br />
my husband was suspended from work ( he works in the medical profession),some people stopped talking to us but our close friends and family were such a support...my husbands workplace paid for family counselling,as we were left to pick up the pieces  of our shattered lives....it was like a bomb going off and bits of shrapnel hitting everyone..<br />
i have done from the beginning and still do to this day believe DOCS is more about protecting themselves than finding the truth...<br />
i truly feel for anyone who is falsely accused of child abuse and finds themselves dealing with the child protection service.....and they say we are the the dysfunctional ones...]]></description>

The things I'm reading in there of the admission of the government having failed children and putting them in abusive situations in institutions when most of them were removed or placed as state wards due to families being unable to provide for them in the 1900 - to around 1948 when a payment started to be initiated for families and especially in 1973 for family allowance when the most reduction of children were put into care...<br />
<br />
The aboriginals however were placed in care for being aboriginal, full, half or quarter caste and the more whiter they could look they tried to assimilate them into white society but how they tried to do this in the abysmal and deplorable conditions they were made to live in is beyond belief...Ms Forde comments on the fact that children in private homes were put into care if they were found to be treated in the same manner.  <br />
<br />
I've got 304 pages to read and it's interesting so far...but it's very sad that any child has had to experience this sort of suffering and under the hands and guise of a caring government who is responsible for the failure of these children...<br />
<br />
Chapter 5 actually starts with as a sub heading:  <span style="font-style: italic;">The State is not a good parent</span>  Got that statement right.  I admit that there are children today and may have been years ago needed saving from unsuitable and abusive conditions, but prevention and intervention is the key, not control, dismissal of parents and their feelings and one size fits all approach.  <br />

SEVEN cases ending in young people committing suicide were not probed when last reported to Queensland's Child Safety Department, a report says.<br />
<br />
The Queensland Commission for Children and Young People's annual report into deaths of children and young people was tabled in Parliament today. <br />
<br />
The report said that of the 64 children and young people known to the department who died in 2007-08, five children were in the care of the department at the time of their death. <br />
<br />
Of the 64 children, 28 died of natural causes and 14 of accidents - including seven in car accidents, two in drownings, three in fires and two in other accidents. <br />
<br />
Eight died after fatal assaults, a further eight died due to suspected suicides, and four deaths were put down to SIDS. <br />
<br />
Fifty-seven deaths occurred where the child was in the care of either one or both of its biological parents, and two other children were in the care of another relative. <br />
<br />
Of the five children in the department's care at the time of their death, four died of natural causes, and the fifth went into care after the assault that eventually caused their death. <br />
<br />
The Child Death Case Review Committee, whose annual report was also released today, noted there was no investigation into seven of the eight young people who died of suspected suicides when they were last brought to the department's attention - even though six had a recorded history of suicide attempts. <br />
<br />

SEVEN cases ending in young people committing suicide were not probed when last reported to Queensland's Child Safety Department, a report says.<br />
<br />
The Queensland Commission for Children and Young People's annual report into deaths of children and young people was tabled in Parliament today. <br />
<br />
The report said that of the 64 children and young people known to the department who died in 2007-08, five children were in the care of the department at the time of their death. <br />
<br />
Of the 64 children, 28 died of natural causes and 14 of accidents - including seven in car accidents, two in drownings, three in fires and two in other accidents. <br />
<br />
Eight died after fatal assaults, a further eight died due to suspected suicides, and four deaths were put down to SIDS. <br />
<br />
Fifty-seven deaths occurred where the child was in the care of either one or both of its biological parents, and two other children were in the care of another relative. <br />
<br />
Of the five children in the department's care at the time of their death, four died of natural causes, and the fifth went into care after the assault that eventually caused their death. <br />
<br />
The Child Death Case Review Committee, whose annual report was also released today, noted there was no investigation into seven of the eight young people who died of suspected suicides when they were last brought to the department's attention - even though six had a recorded history of suicide attempts. <br />

QUEENSLAND'S Child Safety Department knew that a 10-year-old girl had been gang-raped but did not report it to police, despite the girl also contracting a sexually transmitted disease from the encounter.<br />

The child - who had been living in a Cairns foster home before the department decided to return her to Aurukun, in Cape York - has been diagnosed as "mildly intellectually impaired" and suffering from fetal alcohol syndrome, having been born to an alcohol-dependent mother.<br />
<br />
The Australian yesterday revealed nine males who pleaded guilty to gang-raping the girl had escaped a prison term, with sentencing judge Sarah Bradley saying the child victim "probably agreed" to have sex with them.<br />
<br />
An eight-month investigation was conducted into the April 2006 multiple rape and submitted to the Department of Child Safety, resulting in one senior officer being sacked and two others suspended for 12 months on full pay - a situation that still exists.<br />
<br />
A senior departmental official yesterday told The Australian that the child involved was sexually abused at age seven and, as a safety measure, was put with various foster families, eventually ending up in 2005 with a non-indigenous family in Cairns. But she was returned nine months later to Aurukun, where she was gang-raped by the nine males.<br />
<br />
"These non-indigenous people were fantastic - ensuring she went to school, and the father actually took a year off his work to personally supervise this girl," he said. "But two new social workers were appointed to the north and they expressed the view, which was repeated many times to the investigating committee, that putting an indigenous child with white foster parents was another stolen generation.<br />
<br />
"They convinced the department with this rubbish and the girl was taken from Cairns to Aurukun - back to where she was being abused previously and where she had contracted syphilis as a little child - and she was unsupervised, with the result that she was constantly raped.<br />
<br />
"The report sets out how every step of the way the Child Safety Department did everything wrong, and all because they weretold that a safe, white environment was `another stolen generation'."<br />
<br />
A report of the rape in The Australian yesterday sparked animmediate response, with Queensland Attorney-General Kerry Shine announcing he would lodge an appeal against the sentencing of the nine attackers.<br />
<br />
But Mr Shine admitted the appeal would be hampered by the fact the prosecutor in the case, Steve Carter, did not recommend jail. Mr Carter yesterday refused to speak to The Australian about the sentences, referring questions to the DPP's office in Brisbane.<br />
<br />
The Queensland Government also ordered a review of every sentence handed down in every sexual assault case in Cape York communities in the past two years.<br />
<br />
Premier Anna Bligh said the purpose of the review was to examine whether the sentence in the Aurukun rape case was part of"system-wide" problems in the Cape.<br />
<br />
"I want to satisfy myself that the people of Cape York, and the people who live in remote indigenous communities, are receiving the same level of justice as we can expect in any other community in Queensland," Ms Bligh said. "I do want to satisfy myself that this is not part of a broader sentencing trend that reflects a lower standard for those communities."<br />
<br />
The case also prompted questions as to whether the federal intervention in Northern Territory Aboriginal communities should be extended to Queensland in an effort to prevent such abuses occurring again.<br />
<br />
Prime Minister Kevin Rudd refused to commit to a such a move, saying: "I think the appropriate thing is to await the further deliberation of Queensland's Attorney-General."<br />
<br />
The official report produced following the eight-month investigation states that a senior Child Safety officer was told on May 11 last year that the child had gonorrhea. It was revealed after the girl attended the Aurukun medical clinic on May 5 last year asking for a pregnancy test and condoms.<br />
<br />
That information was immediately relayed to Child Safety, but the senior Child Safety officer did not pass the information on to police in line with her statutory obligations, and when questioned about it said she had spent several weeks making inquiries if gonorrhea was contractable through means other than sexual transmission.<br />
<br />
The investigating committee also reported that the Child Safety officers took no remedial action when the girl threatened to commit suicide.<br />
<br />
The committee's findings of failures by the Child Safety Department included possible non-reporting of other criminal offences against children to police, other possible early returns of indigenous children to their communities without sufficient prior consideration, and failure to record a suicide risk alert regarding the raped child's threat to suicide and whether this is indicative of a broader problem.<br />
<br />
The report's findings also highlighted a loss of departmental documents including the child's Suspected Child Abuse and Neglect (SCAN) file and other SCAN files; a lack of knowledge by staff of what diseases constitute sexually transmitted diseases; and a lack of knowledge by staff of what may constitute a criminal offence on a child.<br />
<br />
The committee also found the child had first contracted syphilis in April 2002 when she was aged seven and was raped by five juveniles in Aurukun, receiving severe genital injuries.<br />
<br />
When sentencing the nine juveniles for the gang rape carried out last year, Judge Bradley said: "All of you have pleaded guilty to having sex with a 10-year-old girl and (one of the juveniles) has pleaded guilty to having sex with another young girl as well.<br />
<br />
"All of you have to understand that you cannot have sex with a girl under 16.<br />
<br />
"If you do, you are breaking the law, and if you are found out, then you will be brought to court and could end up in jail.<br />
<br />
"I accept that the girl involved, with respect to all of these matters, was not forced, and that she probably agreed to have sex with all of you."<hr />
